Tofu

Terms of Service

Terms for guests · Last updated: October 2026 · Deutsche Fassung (maßgeblich)

This English version is provided for convenience. In case of any discrepancy, the German version (AGB) prevails.

1. Scope and provider

These terms apply to guests using Tofu, i.e. table reservations made through restaurants' booking pages and widgets, through Tofu's phone assistant and through AI assistants such as ChatGPT or Claude. Tofu is provided by Ninja Food GmbH, Lindenthalgürtel 2, 50935 Köln, Germany (see legal notice), “Tofu” or “we”.

Restaurants that use Tofu as software have separate agreements; these terms do not govern them.

2. What Tofu does

Tofu is reservation software for restaurants. Guests can use it to see free times at participating restaurants, reserve a table, and change or cancel the reservation. Restaurants decide which channels they are bookable through, in particular whether they can be found and booked through AI assistants.

Using Tofu is free of charge for guests. No account is required.

3. Your agreement is with the restaurant

A reservation creates an agreement solely between you and the restaurant. Tofu is not a party to that agreement; it delivers and manages the reservation on the restaurant's behalf as its technical service provider. The restaurant alone is responsible for what happens on site (table, food, drinks, service, prices).

A reservation is accepted once it is shown to you as confirmed or confirmed by email or text message. The content of that confirmation is decisive. Some restaurants review requests before confirming them; you will be told when booking.

4. Reservations through AI assistants

When you use an AI assistant (e.g. ChatGPT by OpenAI or Claude by Anthropic), the assistant sends your reservation details to Tofu on your behalf. The assistant is not operated by Tofu; its provider's terms and privacy policy apply to your use of it.

A reservation is only created after you have explicitly confirmed it to the assistant. Check the summary (restaurant, date, time, party size, name, contact details) before confirming. The content of your reservation is defined by Tofu's confirmation (Tofu's response in the chat and the confirmation email), not by differing wording of the assistant. Statements by the assistant that do not come from Tofu (e.g. its own recommendations) are not adopted by Tofu.

5. Your obligations

  • Provide truthful and complete information, in particular name, contact details and party size, and only book for yourself or for people on whose behalf you act.
  • Only reserve tables you actually intend to use. Duplicate or fake reservations and automated bulk requests are not permitted.
  • If you cannot come or fewer people are coming, change or cancel the reservation as early as possible.
  • Do not misuse Tofu, e.g. by circumventing technical limits or interfering with its operation.

6. Changes and cancellation

Every confirmation contains a personal link to change or cancel the reservation. For reservations made through an AI assistant you can give the assistant this link and ask it to cancel. Restaurants may set deadlines for online changes and cancellations; after the deadline, or if the restaurant does not offer online cancellation, please contact the restaurant directly. Do not share the link with others.

7. No-shows

The restaurant decides how no-shows and late arrivals are handled and may give the table to other guests after a reasonable waiting time. If a restaurant requires a card guarantee or deposit for certain reservations, it will tell you separately; a payment or card authorisation only happens if you agree to it. It is processed by the payment provider Stripe directly for the restaurant; Tofu receives nothing. Whether a no-show fee applies, and how much, depends solely on your agreement with the restaurant and applicable law.

8. Availability

Tofu shows free times as released by the restaurant at the time of the request. You are only entitled to a particular time, table or area once the reservation is confirmed. Seating wishes are not binding unless the restaurant expressly confirms them. We aim to keep Tofu available at all times but cannot guarantee it, e.g. during maintenance, outages or failures of service providers.

9. Liability

Tofu is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.

For slightly negligent breaches of an essential contractual obligation, liability is limited to the foreseeable damage typical for this type of contract. Essential obligations are those whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. Otherwise, Tofu is not liable for slight negligence.

These rules also apply to the personal liability of our legal representatives, employees and agents. The restaurant's liability towards you is governed by your agreement with the restaurant and the law.

10. Privacy

How we process your data — including for reservations through AI assistants — is described in our privacy policy (German).

11. Changes to these terms

We may change these terms for the future, e.g. for new features or changes in the law. A reservation is governed by the version published at the time of booking.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection rules of the country of your habitual residence remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If any provision of these terms is invalid, the remaining provisions remain valid; the statutory rules replace the invalid provision.
